Overview : CDSCO Registration

CDSCO registration is a commonly used term for regulatory registrations, licences and permissions administered by the Central Drugs Standard Control Organisation in India. Businesses dealing in medical devices, pharmaceuticals, imported cosmetics and certain regulated research activities may need an approval under the applicable law before starting their proposed activity.

There is no single CDSCO registration certificate that authorises every healthcare product or business activity. The correct regulatory pathway depends on what the product is, whether it will be manufactured or imported, and whether the activity requires approval from CDSCO, a State Licensing Authority or both.

Legal Papers India Business Solution Private Limited is a private business-registration and compliance consultancy. Businesses can contact the company to discuss their proposed activities, confirm the availability of relevant regulatory assistance and request a quotation.

What Is CDSCO Registration?

CDSCO stands for the Central Drugs Standard Control Organisation, India's national regulatory authority for specified drugs, medical devices, cosmetics and related activities. The expression "CDSCO registration" can refer to different processes, including medical device import licensing, drug import permissions, cosmetic import registration and applications involving new drugs or clinical trials.

Some permissions are issued by the Central Licensing Authority, while others are handled by State Licensing Authorities under the relevant regulatory framework.

Before applying, a business must identify the product category, intended activity, applicable legislation and correct issuing authority.

What Does CDSCO Regulate in India?

CDSCO performs regulatory functions under the Drugs and Cosmetics Act, 1940 and related rules, including the Drugs Rules, 1945, Medical Devices Rules, 2017, New Drugs and Clinical Trials Rules, 2019 and Cosmetics Rules, 2020.

Medical Devices
Medical devices include regulated equipment, instruments, implants and other products intended for specified medical purposes.
The applicable pathway depends on the device's classification, intended use and proposed activity.

In-Vitro Diagnostic Medical Devices
IVDs include regulated products used to examine specimens obtained from the human body for diagnostic or related purposes.
They follow the relevant medical-device framework, with requirements specific to their classification and performance.

Pharmaceuticals and Drugs
CDSCO has responsibilities concerning new drugs, drug imports, certain approvals, clinical trials and other centrally regulated activities.
Routine manufacturing and sale licences for many drugs are issued by State Licensing Authorities under the applicable framework.

Cosmetics
Imported cosmetics are subject to the registration requirements of the Cosmetics Rules, 2020.
Domestic cosmetic manufacturing is regulated through the applicable State Licensing Authority framework.

Clinical Trials and Research
Certain clinical trials, new-drug studies, bioavailability or bioequivalence activities and investigations involving medical devices require specific regulatory permissions.
These activities cannot be authorised through an ordinary commercial import or distribution licence.

Who Needs CDSCO Registration or Approval?

The requirement depends on the regulated activity rather than the business name alone.

1. Medical Device Importers
Businesses importing regulated medical devices for commercial sale generally need the applicable import authorisation, unless a specific exemption applies.

2. Medical Device Manufacturers
Indian manufacturers need to determine the correct licensing authority and manufacturing form according to device risk classification and manufacturing arrangements.

3. Pharmaceutical Importers
Businesses importing regulated drugs must assess the relevant import licence, product registration and any special permissions required for the drug category.

4. Cosmetic Importers
Businesses importing cosmetics into India must follow the applicable import registration framework, including the prescribed product, manufacturing-site and variant particulars.

5. Medical Device Retailers and Distributors
Businesses selling, stocking or distributing regulated medical devices must hold an appropriate authorisation.
Depending on their existing permissions and activities, this may involve MD-42 registration or a qualifying drug-sale licence.

6. Clinical Trial Sponsors and Research Organisations
Sponsors and research organisations must identify whether the proposed activity requires a clinical trial, ethics committee, test-import or another specialised permission.

Is CDSCO Registration Mandatory for Every Healthcare Product?

No. The requirement depends on the product's legal classification, intended use and activity.
A product marketed as a wellness item, medical device, cosmetic or drug cannot be classified reliably from its marketing name alone.

For example, qualifying Class A non-sterile and non-measuring medical devices are exempt from the ordinary manufacturing and import licensing requirements, subject to the applicable registration-number framework.
This exemption does not apply automatically to all Class A devices or to products supplied sterile or with a measuring function.

A business should confirm its exact regulatory category before paying an application fee.
