Overview : Drug License

A Drug License is the legal authorisation required for businesses undertaking regulated activities involving the sale, stocking or distribution of medicines in India. Retail pharmacies, medical stores and pharmaceutical wholesalers generally need the appropriate licence under the Drugs and Cosmetics Act, 1940 and the Drugs Rules, 1945.

For ordinary retail and wholesale drug-sale activities, the licence is generally issued by the concerned State or Union Territory Drugs Control Licensing Authority. The application requirements depend on the medicines being handled, the business activity, the premises and the qualified person responsible for supervising the operation.

Legal Papers India Business Solution Private Limited is a private business-registration and compliance consultancy. You can contact the company to discuss your proposed drug-sale business and enquire about the availability of professional licensing assistance.

What Is a Drug License?

A Drug License is an authorisation issued under the applicable drug-control laws for activities such as selling, stocking, exhibiting or offering for sale, or distributing specified categories of drugs.
In India, the principal legal framework includes the Drugs and Cosmetics Act, 1940 and the Drugs Rules, 1945, as amended. The appropriate licence depends on the activity and product category.

For example, a pharmacy selling medicines to patients ordinarily requires a retail sale licence, while a pharmaceutical distributor supplying medicines to other licensed businesses generally requires a wholesale licence.
Drug manufacturing, import, medical-device licensing and certain other regulated activities involve different permissions and procedures.

A company registration certificate, GST registration or ordinary trade licence does not replace a required drug-sale licence.

Who Needs a Drug License in India?

Businesses that undertake regulated sale, stocking or distribution of medicines generally require the appropriate licence before commencing those activities.

1.Retail Medical Stores and Pharmacies
A retail pharmacy supplying medicines to customers generally requires a retail drug-sale licence.
The premises must satisfy the applicable conditions, and the sale or dispensing of medicines must be supervised as prescribed.

2. Pharmaceutical Wholesalers and Distributors
A business supplying medicines to pharmacies, hospitals, clinics or other authorised purchasers generally requires a wholesale drug licence.
Wholesale licensing has distinct requirements concerning the premises and the competent person supervising operations.

3. Businesses Operating Retail and Wholesale Activities Together
A business carrying out both retail and wholesale drug-sale activities may require the relevant licences for both categories.
The premises must meet the applicable combined-area and operational requirements.

4. Businesses With Multiple Medicine-Sale Locations
Where drugs are sold or stocked for sale at more than one place, Rule 62 generally requires a separate application and licence for each premises, subject to its specific exception.
Opening a second pharmacy should therefore not be treated as automatically covered by the first shop's licence.

5. Businesses That Need a Different Regulatory Approval
Drug manufacturing, imports, medical-device activities and certain specialised pharmaceutical operations follow separate licensing frameworks.
Businesses dealing in Ayurvedic, Siddha, Unani or homoeopathic medicines should also identify the specific applicable legal provisions and licence category.

A general allopathic retail or wholesale drug-sale licence should not be assumed to authorise every pharmaceutical activity.

Types of Drug Licenses in India

Different statutory forms apply to different drug categories and sale activities.

Licence Form

General Purpose

Form 20

Retail sale of drugs other than those in Schedules C, C(1) and X

Form 21

Retail sale of drugs in Schedules C and C(1), excluding Schedule X

Form 20B

Wholesale sale of drugs other than those in Schedules C, C(1) and X

Form 21B

Wholesale sale of drugs in Schedules C and C(1), excluding Schedule X

Form 20A

Restricted retail licence for specified eligible drugs

Form 21A

Restricted retail licence for specified Schedule C(1) drugs

Form 20F

Retail sale of drugs specified in Schedule X

Form 20G

Wholesale sale of drugs specified in Schedule X
Form 20C/20D Relevant homoeopathic medicine sale categories

The application form and licence category must be selected according to the medicines and business activity involved.

For ordinary allopathic retail and wholesale licensing, Form 19 is an important application form under Rule 59. Specialised categories may require other application forms and conditions.

Retail Drug License for Medical Stores

A retail drug licence is generally required to operate a medical store or pharmacy selling regulated medicines to customers. The licensing authority examines the proposed premises, storage arrangements and availability of a registered pharmacist where required.

Registered Pharmacist Requirement
A regular retail pharmacy operating under the relevant licence categories generally requires the prescribed supervision of a registered pharmacist.
The pharmacist's qualification and registration must satisfy the applicable legal requirements.
Merely naming a pharmacist in an application is not a substitute for complying with the actual supervision obligations.

Pharmacy Premises
The premises must be suitable for storing and selling the proposed medicines.
Requirements may include adequate floor area, appropriate storage, cleanliness and equipment necessary to preserve the medicines' properties.
Pharmacies must also satisfy the relevant requirements of Schedule N, where applicable.

Restricted Retail Licences
Certain restricted retail licences are available for specified categories of drugs and under particular legal conditions.
They should not be treated as a general alternative to employing a registered pharmacist for an ordinary pharmacy.
The licensing authority must determine whether the proposed activity qualifies for the restricted category.

Wholesale Drug License for Pharmaceutical Distributors

A wholesale drug licence is generally required for businesses supplying medicines through wholesale distribution channels.

The relevant licence forms include Form 20B and Form 21B, depending on the categories of drugs.

  • Competent Person Requirement
Wholesale premises must be under the supervision of a person satisfying the applicable competent-person requirements. A registered pharmacist may qualify. The Rules also recognise certain other qualification-and-experience combinations for the relevant wholesale categories.

The applicant should verify the proposed competent person's eligibility with the concerned licensing authority. A wholesale business should not assume that every employee with pharmaceutical sales experience automatically meets the statutory requirements.

  • Storage and Distribution Arrangements
Wholesale premises must have adequate storage facilities appropriate for the drugs being handled. Medicines requiring special temperature conditions must be stored accordingly.
The business must also comply with the applicable purchase, sale, recordkeeping and distribution conditions.

  • Minimum Area Required for a Drug License
Premises size is an important eligibility requirement for ordinary retail and wholesale drug-sale licensing.
For the relevant Form 20, Form 21, Form 20B and Form 21B categories, the following area requirements are commonly applicable under the regulatory framework.

Activity

Minimum Premises Area

Retail drug sale

10 square metres

Wholesale drug sale

10 square metres

Combined retail and wholesale sale

15 square metres

The licensing authority also examines whether the premises are suitable for the proposed business. Floor area alone does not establish eligibility.

The premises must satisfy applicable storage, supervision, building-use and other regulatory requirements. Additional local requirements may apply. For example, the Delhi Drugs Control Department publishes specific premises-height and permitted-use conditions for its jurisdiction.

Before taking a property on rent, confirm that it can lawfully be used for the intended medicine-sale activity.

Eligibility Requirements for Drug License Registration

The licensing authority assesses whether the applicant, premises and proposed operation satisfy the applicable conditions.

Eligible Business Structures
Depending on the relevant legal requirements, applicants may operate through structures such as:

  • Sole proprietorship.
  • Partnership firm.
  • Limited liability partnership.
  • Private limited company.
  • Other eligible organisations.

The applicant must provide the documents appropriate to its business structure.

Suitable Commercial Premises
The proposed premises must satisfy the applicable area, storage and use requirements.
Ownership or lawful occupation of the premises must be supported by appropriate documents.

Qualified Supervisory Personnel
Retail and wholesale operations have different supervisory requirements.
An ordinary retail pharmacy generally needs the prescribed registered-pharmacist supervision.
Wholesale operations require an eligible competent person.

Appropriate Drug Categories
The applicant must identify the categories of medicines it intends to sell or distribute.
A licence for one category does not automatically authorise activities requiring another licence.

Documents Required for Drug License Registration
The precise document checklist varies by State or Union Territory, licence type and applicant structure.
The following documents are commonly relevant to ordinary retail and wholesale applications.

Business and Applicant Documents

  • Business constitution or incorporation documents.
  • Applicant and authorised-signatory details.
  • PAN and other applicable business registration information.
  • Authorisation or board resolution, where required.
  • Prescribed declarations and affidavits.

Premises Documents

  • Ownership or tenancy evidence.
  • Site plan and key plan.
  • Address and permitted-use documents.
  • Additional building or local-authority permissions where applicable.

Pharmacist Documents for Retail Applications

  • Recognised qualification evidence.
  • State Pharmacy Council registration evidence.
  • Appointment or employment details.
  • Prescribed declaration or affidavit.
  • Other documents required by the authority.

Competent Person Documents for Wholesale Applications

  • Qualification documents.
  • Relevant experience evidence, where applicable.
  •  Appointment details.
  • Prescribed declarations.
  • Any additional authority-specific documents.

Storage and Operational Information
The authority may request information about refrigeration, cold storage, storage arrangements or other equipment relevant to the medicines being handled.
The applicant should use the latest official checklist rather than assume that a document list copied from another State is sufficient.

Drug License Online Application Process in India

Retail and wholesale drug-sale applications are generally processed through the concerned State or Union Territory licensing authority.

The exact online portal and workflow vary by jurisdiction.

Step 1: Identify the Required Licence
Determine whether the proposed business will operate as a retail pharmacy, wholesale distributor or combined retail-and-wholesale establishment.
Identify the medicines and statutory categories involved.

Step 2: Confirm Premises Suitability
Check the floor area, lawful use of the premises and storage arrangements.
Where necessary, confirm that the premises satisfy local building and municipal requirements.

Step 3: Arrange the Required Professional Supervision
For an ordinary retail pharmacy, arrange for the appropriate registered pharmacist.
For wholesale operations, identify an eligible competent person.
Verify the relevant qualifications and registrations before filing.

Step 4: Prepare the Application Documents
Collect the business, premises, professional and operational documents required by the authority.
Check consistency between the application and supporting records.

Step 5: Apply Through the Appropriate Government Channel
Use the official State/UT Drugs Control application system.
Complete the prescribed application form and upload the required supporting documents.
For relevant ordinary sale licences, Form 19 is used under the Drugs Rules.

Step 6: Pay the Prescribed Government Fee
Pay the fee applicable to the selected licence category and application.
The amount and payment procedure should be checked against the current rules and the authority's fee schedule.
Keep the payment receipt and application acknowledgement.

Step 7: Complete Inspection and Verification
The licensing authority may examine the documents and inspect the proposed premises.
The inspection can cover storage conditions, premises suitability, professional supervision and other applicable requirements.
The applicant must provide accurate information and address any official observations.

Step 8: Receive the Licensing Decision
If the authority is satisfied that the applicable requirements are met, it may issue the relevant drug-sale licence.
The licence specifies the authorised premises and drug categories.
Application submission or fee payment does not itself authorise the business to begin regulated drug-sale operations.

Drug License Government Fees and Consultancy Charges

Government application fees depend on the licence category and applicable rules.

Rule 59 of the Drugs Rules contains fee provisions for relevant drug-sale applications. However, the applicant should verify the current applicable amount and fee-payment instructions before filing. The total cost of establishing a medical store or pharmaceutical distribution business may include several components.

Cost Component

Treatment

Government application fee

Depends on applicable licence categories

Licence retention fee

Payable under the applicable five-year retention framework

Professional consultancy fee

Separate quotation

Premises and storage arrangements

Depends on business requirements

Pharmacist or competent-person arrangements

Depends on lawful staffing requirements

Other conditional documentation

Depends on jurisdiction and application

A government fee should not be represented as the total cost of obtaining and maintaining a compliant drug-sale business. Applicants may apply directly through the government process without engaging a private consultant.

Contact Legal Papers India to enquire about professional assistance and obtain a quotation.

How Long Does Drug License Registration Take?

There is no single processing period that should be promised for every retail or wholesale drug licence application throughout India. The duration depends on the jurisdiction, application completeness, premises inspection, professional-document verification and any deficiencies identified by the authority.

A business may need additional time before submission to arrange suitable premises, storage equipment or qualified supervisory personnel. The official application process begins according to the relevant authority's requirements.

Applicants should distinguish document-preparation time from the government's examination and approval process. Avoid relying on a guaranteed approval date offered by a private service provider.

Drug License Validity and Retention Fee

Rule 63 of the Drugs Rules provides a retention-fee framework for specified drug-sale licences. For the listed licence categories, the licence remains valid if the licensee pays the required retention fee before the end of each successive five-year period, unless the licence has been suspended or cancelled.

The retention fee is generally equivalent to the respective fee for granting the licence. If payment is delayed, the Rules provide for additional charges and eventual deemed cancellation in the circumstances specified.

This is different from assuming that every retail or wholesale drug-sale licence automatically expires and requires a completely new application every five years. The licensee must also continue satisfying the applicable conditions.

Drug License for Multiple Medical Stores or Branches

  • A business operating several medical stores should not assume that one drug-sale licence covers every location.

  • Rule 62 generally requires a separate application and licence for each place where drugs are sold or stocked for sale, subject to the rule's stated exception.

  • For example, a pharmacy business opening a second branch ordinarily needs to assess the separate licensing requirements for that premises.

  • Each location must satisfy its own relevant premises, storage and supervision requirements.

  • A common company name or GST registration does not eliminate the drug-licensing requirements for individual premises.

Compliance Requirements After Receiving a Drug License

A drug-sale licence carries continuing obligations.

Maintain Qualified Supervision
The business must maintain the registered-pharmacist or competent-person supervision required for its licence.
Changes in the responsible person should be handled according to the applicable authority procedure.

Follow Storage Conditions
Medicines must be stored in conditions suitable for maintaining their quality.
Products requiring refrigeration or other special conditions need appropriate facilities.

Maintain Purchase and Sale Records
Licensed businesses must comply with applicable invoicing, purchase, sale and recordkeeping requirements.
Additional controls apply to certain scheduled medicines.

Sell Only Authorised Drug Categories
The business should not sell or distribute medicines outside the categories permitted by its licence or in violation of applicable statutory restrictions.

Maintain Premises Compliance
Changes to the premises, business constitution or other material particulars may require regulatory action.
In some circumstances, a fresh licence may be necessary.

Pay Retention Fees on Time
The licensee should maintain a compliance calendar for the five-year retention-fee requirement and any other applicable obligations.

Common Reasons for Drug License Application Problems

  • Unsuitable Premises
Insufficient floor area, inappropriate building use or inadequate storage arrangements may prevent approval.
    Missing Pharmacist or Competent-Person Evidence
The authority must be satisfied that the required professional supervision arrangements are in place.

  • Incorrect Licence Category
Selecting a retail form for wholesale activity, or overlooking a special drug category, may result in an unsuitable application.
    Inconsistent Business Documents
Differences in the business name, premises address or responsible-person details can lead to queries.

  • Incomplete Applications
Missing declarations, plans or supporting records may delay scrutiny.

  • Incorrect Assumptions About Validity
The five-year retention-fee requirement should not be confused with a universal requirement to submit a fresh licence application every five years.

Frequently Asked Questions

1. Is a Drug License mandatory for a medical store in India?

Yes. An ordinary medical store selling regulated medicines generally requires the appropriate retail drug-sale licence under the Drugs and Cosmetics Act, 1940 and the Drugs Rules, 1945. The applicant must satisfy the relevant premises, storage and professional-supervision requirements. Company registration or GST registration does not replace the drug-sale licence.

2. What is the difference between a retail and wholesale Drug License?

A retail drug licence authorises specified sale activities involving customers, while a wholesale licence covers the relevant wholesale distribution activities. Different statutory licence forms and supervisory conditions apply. For example, ordinary retail operations generally require registered-pharmacist supervision, whereas relevant wholesale licences permit supervision by an eligible competent person.

3. Can I apply for a Drug License online?

Yes. State and Union Territory Drugs Control authorities provide application systems for the relevant drug-sale licences. The applicant must use the appropriate official channel, submit the prescribed form and supporting documents, pay the required fee and complete the authority's verification process. The exact workflow depends on the jurisdiction.

4. Is a registered pharmacist compulsory for a medical store?

For an ordinary retail pharmacy operating under the relevant licence categories, registered-pharmacist supervision is generally required. Restricted retail licences exist for specified circumstances but are not a universal alternative. The applicant should confirm the precise requirements for the proposed medicines and licence category with the licensing authority.

5. Can I get a wholesale Drug License without being a pharmacist?

The relevant wholesale licensing provisions recognise an eligible competent person, who may be a registered pharmacist or may qualify through certain prescribed education-and-experience combinations. The proposed person's qualifications must satisfy the applicable Rules and authority requirements. An applicant should not assume that any sales employee qualifies.

6. What is the minimum shop area required for a Drug License?

For relevant ordinary retail or wholesale drug-sale licence categories, the minimum area is generally 10 square metres. Combined retail and wholesale operations generally require at least 15 square metres. Premises must also satisfy storage, suitability and applicable local requirements. Meeting the area threshold alone does not guarantee licensing approval.

7. Can one Drug License cover two medical stores?

Generally, no. Rule 62 requires separate licensing for separate places where drugs are sold or stocked for sale, subject to the rule's specific exception. A pharmacy business opening another branch should assess the licensing requirements for that premises independently, even if both stores belong to the same company.

8. How long is a Drug License valid in India?

For the relevant sale-licence categories listed in Rule 63, the licence remains valid subject to payment of the prescribed retention fee at each successive five-year interval, unless suspended or cancelled. This is not the same as a universal five-year expiry requiring a completely new application.

9. What is the government fee for Drug License registration?

The fee depends on the applicable licence category and statutory provisions. Rule 59 contains fees for relevant sale-licence applications, while other categories may have different requirements. Applicants should verify the current fee schedule and payment instructions with the concerned authority rather than rely on an undifferentiated online cost estimate.

10. Is a Drug License required for pharmaceutical wholesale distribution?

Yes. A business undertaking regulated wholesale sale or distribution of medicines generally needs the appropriate wholesale licence, such as Form 20B or Form 21B for the relevant categories. The premises, storage arrangements and competent-person supervision must satisfy the applicable requirements.

11. Can a private limited company apply for a Drug License?

Yes. A private limited company may apply for the relevant drug-sale licence if it satisfies the applicable requirements. It must provide the necessary company and authorisation documents, suitable premises and qualified supervision. Incorporation alone does not authorise the company to sell or distribute regulated medicines.

12. Does a Drug License allow medicine manufacturing?

No. A retail or wholesale drug-sale licence should not be treated as authorisation to manufacture medicines. Manufacturing activities are regulated through separate licence categories and procedures. Businesses planning to manufacture, import and distribute medicines should identify the permissions required for each proposed activity.

13. Can I change my pharmacist after obtaining the licence?

A change in the registered pharmacist or other responsible technical person must be handled according to the applicable authority procedure. The business must maintain the legally required supervision arrangements. State Drugs Control departments publish specific document requirements for reporting or approving such changes.

14. What happens if I miss the Drug License retention fee?

Rule 63 provides for a late fee calculated at two per cent of the licence fee for every month or part of a month, for up to six months, where the retention fee is not paid on time. Continued non-payment can result in deemed cancellation under the rule. Licensees should verify their due dates and pay before expiry of the relevant interval.

15. Can I apply for a Drug License without a consultant?

Yes. Applicants can use the relevant official government application process directly. Engaging a private consultant is optional. Professional assistance may help with understanding requirements and organising documents if those services are offered, but approval remains the responsibility of the competent government licensing authority.
